The Official Controls and Phytosanitary Conditions (Amendment) Regulations 2021 (Reglamento sobre Controles Oficiales y Condiciones Fitosanitarias [Modificación], de 2021)

This measure corrects an amendment enacted by provisions in the Official Controls and Phytosanitary Conditions (Amendment) Regulations 2021 (S.I. 2021/136) relating to measures against the import of host plants of Xylella fastidiosa (Wells et al.). The notification was distributed on 19 February 2021. The original notified text is again provided as an attachment with an explanatory footnote on page 7 indicating the amendment that is to be made.


Erroneous wording implied the exclusion of olive and almond plants grown in vitro from the import requirements, in contradiction to the requirements themselves, which correctly set out the conditions applicable to such plants grown in vitro. Deleting this statement removes ambiguity and ensures that these imports can occur, on the condition that they meet the relevant requirements.
La mesure notifiée corrige une modification établie dans les dispositions du Règlement de 2021 sur les contrôles officiels et les conditions phytosanitaires (modification) (S.I. 2021/136) concernant les mesures contre l'importation de plantes hôtes de Xylella fastidiosa (Wells et al.). La notification a été distribuée le 19 février 2021. Le texte original de la notification est à nouveau soumis en pièce jointe avec une note explicative à la page 7 indiquant la modification à apporter.
La formulation erronée impliquait l'exclusion des oliviers et amandiers cultivés in vitro des prescriptions en matière d'importation, en contradiction avec les prescriptions elles-mêmes, qui énoncent correctement les conditions applicables à ces plantes cultivées in vitro. La suppression de cette mention lève l'ambiguïté et garantit que ces importations peuvent avoir lieu, à condition qu'elles respectent les prescriptions pertinentes.

La medida notificada corrige una modificación establecida en las disposiciones del Reglamento sobre Controles Oficiales y Condiciones Fitosanitarias (Modificación), de 2021 (S.I. 2021/136), relativas a las medidas contra la importación de plantas hospedantes de Xylella fastidiosa (Wells et al.). La notificación se distribuyó el 19 de febrero de 2021. El texto original notificado se presenta de nuevo como anexo con una nota explicativa en la página 7 en la que se indica la modificación que ha de realizarse.
La redacción errónea implicaba la exclusión de los olivos y almendros cultivados in vitro de las prescripciones en materia de importación, en contradicción con las propias prescripciones, en las que se establecen, correctamente, las condiciones aplicables a estas plantas cultivadas in vitro. La eliminación de esta expresión elimina la ambigüedad y garantiza que esas importaciones puedan producirse, a condición de que cumplan las prescripciones pertinentes.
