This instrument amends the retained Implementing Regulation (EU) 2019/2072 ("the Phytosanitary Conditions Regulation") pursuant to the European Union (Withdrawal) Act 2018 and the European Union (Withdrawal Agreement) Act 2020.


It will introduce measures on pests Scolytus morawitzi and Polygraphus proximus in England, Scotland and Wales (Great Britain) against the import of host plants and other relevant regulated goods. Imports of these high-risk plant goods will only be permitted under certain conditions.


It will also modify existing measures against certain pests, firstly Liriomyza huidobrensis and Liriomyza tifolii, by adding an additional option for host plants destined for final users, and Cronartium species, by excluding pest free countries from the requirements. In addition, it regulates Thaumetopoea processionea as a pest known to occur across Great Britain and adds the leek as a host plant of Leek yellow stripe virus.


This instrument will also alter the regulatory status of other pests:


·         Aonidiella orientalis (a provisional quarantine pest), Diaporthe caulivora (a regulated non-quarantine pest "RNQP") and Heterodera fici (a RNQP) will be deregulated;


·         The GB provisional quarantine pests Eotetranychus sexmaculatus and Platypus apicalis will be listed instead as GB quarantine pests (under official control);


·         Pseudomonas avellanae, Meloidogyne arenaria, Meloidogyne javanica, and Xiphinema index (GB RNQPs) will be added to the GB provisional quarantine pest list (action taken on a provisional basis);


·         Unregulated pests Meloidogyne enterolobii, Agrilus horni, Chilli veinal mottle virus, Chrysobothris femorata and Lycorma delicatula will be added to the GB provisional quarantine pest list.

L'instrument notifié modifie le Règlement d'application conservé (UE) 2019/2072 (Règlement sur les conditions phytosanitaires) conformément à la Loi de 2018 sur l'Union européenne (retrait) et à la Loi de 2020 sur l'Union européenne (accord de retrait).
Il introduira en Angleterre, en Écosse et au Pays de Galles (Grande-Bretagne) des mesures contre l'importation des plantes hôtes des organismes nuisibles Scolytus morawitzi et Polygraphus proximus et d'autres marchandises réglementées pertinentes. L'importation de ces produits végétaux à haut risque ne sera autorisée que dans certaines conditions.
Cet instrument modifiera aussi les mesures existantes contre certains organismes nuisibles: une option supplémentaire sera ajoutée pour les plantes hôtes de Liriomyza huidobrensis et Liriomyza tifolii destinées aux utilisateurs finals; et les pays indemnes des espèces de Cronartium seront exclus des prescriptions. En outre, il réglemente Thaumetopoea processionea en tant qu'organisme nuisible dont la présence en Grande-Bretagne est connue et ajoute le poireau comme plante hôte du virus de la striure du poireau.
Ce texte modifiera aussi le statut réglementaire d'autres organismes nuisibles:
- Aonidiella orientalis (organisme soumis provisoirement à quarantaine), Diaporthe caulivora et Heterodera fici (organismes réglementés non de quarantaine) feront l'objet d'une déréglementation;
- les organismes soumis provisoirement à quarantaine en Grande-Bretagne Eotetranychus sexmaculatus et Platypus apicalis seront désignés comme organismes de quarantaine en Grande-Bretagne (soumis à contrôle officiel);
- Pseudomonas avellanae, Meloidogyne arenaria, Meloidogyne javanica et Xiphinema index (organismes réglementés non de quarantaine en Grande-Bretagne) seront ajoutés à la liste provisoire des organismes de quarantaine de Grande-Bretagne (mesure prise à titre provisoire);
- les organismes nuisibles non réglementés Meloidogyne enterolobii, Agrilus horni, le virus de la marbrure nervaire du piment, Chrysobothris femorata et Lycorma delicatula seront ajoutés à la liste provisoire des organismes de quarantaine de Grande-Bretagne.
El instrumento notificado modifica el Reglamento de Ejecución (UE) 2019/2072 conservado ("Reglamento sobre Condiciones Fitosanitarias") con arreglo a la Ley de la Unión Europea (Retirada) de 2018 y a la Ley de la Unión Europea (Acuerdo de Retirada) de 2020.
Se introducirán medidas relativas a las plagas Scolytus morawitzi y Polygraphus proximus en Inglaterra, Escocia y Gales (Gran Bretaña) para impedir la importación de plantas hospedantes y otras mercancías reguladas pertinentes. Solo se permitirá la importación de dichas mercancías vegetales de alto riesgo en determinadas condiciones.
También se modificarán las medidas existentes contra algunas plagas, principalmente Liriomyza huidobrensis y Liriomyza tifolii, mediante la adición de una nueva opción para las plantas hospedantes destinadas a los usuarios finales, y las especies de Cronartium mediante la exclusión de los países libres de plagas de los requisitos. Además, el instrumento notificado reglamenta la Thaumetopoea processionea como plaga presente en Gran Bretaña y añade el puerro como planta hospedante del virus de la raya amarilla del puerro.
También modifica la situación reglamentaria de otras plagas:
- se desreglamentarán la Aonidiella orientalis (una plaga cuarentenaria provisional), la Diaporthe caulivora (una plaga no cuarentenaria reglamentada "PNCR") y la Heterodera fici (una PNCR);
- las plagas cuarentenarias provisionales de Gran Bretaña Eotetranychus sexmaculatus y Platypus apicalis pasarán a ser plagas cuarentenarias de Gran Bretaña (bajo control oficial);
- Pseudomonas avellanae, Meloidogyne arenaria, Meloidogyne javanica y Xiphinema index (PNCR de Gran Bretaña) se añadirán a la lista de plagas cuarentenarias provisionales de Gran Bretaña (medida adoptada provisionalmente);
- las plagas no reglamentadas Meloidogyne enterolobii, Agrilus horni, virus del moteado de las venas del chile, Chrysobothris femorata y Lycorma delicatula se añadirán a la lista de plagas cuarentenarias provisionales de Gran Bretaña.
